$5,830,000 ($5,115,000 for the value of life and $715,000 for her suffering before death) wrongful death verdict in Fulton State Court: In September, 2009 we received this verdict for the family of a truly remarkable young mother who was killed by a drunk driver.  We could not have represented a finer family - her parents, her sisters, her husband, friends and co-workers all testified about how truly remarkable this woman was.  We are proud of the work we did and proud of bringing some closure for the family.   Under Georgia law the measure of damages for wrongful death has been the full value of the life of the deceased which reflects our respect for the sanctity of human life.  The economic component of the value of the life includes an estimation of lifetime income and employee benefits, with no deduction for personal expenses, including income taxes.  This is the tanglible value of a life, i.e., something you can put a price tag on.  The intangible value of a life, the part that you can't put a price on, includes factors such as the enjoyment of the experience of living and relationships with loved ones.  In the case of the death of a this young parent, the jury considered the value to the mother of being around to raise and nurture her son and to grow old with her husband and grandchildren.

The value of the benefits awarded estimated to be between $3,000,000 and $5,000,000 in a 2008 workers' compensation award in which the judge found that our client’s recent onset of diabetes, secondary neuropathy, weight gain, sleep apnea, pulmonary obstructive lung disease and congestive heart failure were all injuries stemming from a 1995 work related car wreck in which our client suffered a neck injury.   The judge found that the combination of the client’s 1995 injuries and these new superadded injuries satisfied the requirements for catastrophic designation and lifetime catastrophic benefits were awarded client, including housing modifications, new transportation and home health care.
